We know that in agriculture a ‘one size fits all’ approach seldom applies to agricultural tenancies and grazing agreements and we work hard to structure tailored solutions for our landlord and tenant clients. We also recognise that, as the farming business grows, evolves and diversifies, land occupancy agreements may be required outside of the traditional model.

Our commercial background and ethos means that we can advise our clients not only on traditional Farm Business Tenancies and Agricultural Holdings Act Tenancies, but also, where appropriate on more modern licences, farm sharing agreements and contract farming agreements.

Our commercial background means that we are also able to advise on commercial leases and licences where our clients operate diversified businesses.

We act for a number of agricultural tenants in connection with contentious and non-contentious matters relating to their leases. We also regularly assist with the preparation of Agricultural Land Tribunal applications on behalf of our clients.

Whether they be succession, rent review or dilapidation claims, we recognise that the key to success in any Tribunal application lies in forensic examination of our client’s business and the presentation of a strong, detailed and well-argued case before Tribunal (or in negotiations leading up to it).

We work closely with local land agents, surveyors and accountants to ensure that all aspects of our client’s eligibility and suitability are comprehensively assessed and presented with any Agricultural Land Tribunal claim.

Basic Payment and Stewardship obligations

We also assist our clients with their Basic Payment and Stewardship obligations and how best to deal with these on a sale or purchase of land. We work hard to ensure that appropriate safeguards are put in place to deal with environmental standards, cross compliance and greening obligations, as well as the transfer of Stewardship scheme obligations where relevant.

We work closely with local agricultural land agents, surveyors and accountants to ensure that our clients are advised on all aspects of their agricultural transaction, not just the black and white letter of the law. We recognise the importance of keeping up to date with our client’s lenders so that we are able to respond quickly and flexibly to any borrowing requirements that our clients may have.

We act for a large and growing number of farming families and businesses in the region and assist them with every aspect of their agricultural property needs.

Examples of our recent work include the following:

  • Acting in relation to the purchase of a large farm in Cheshire involving the surrender of an existing FBT agreement and subject to planning and development obligations and stewardship scheme commitments, rights of way and multiple Wayleaves;
  • Advising a number of clients on Agricultural Holdings Act 1986 succession applications to the Agricultural Lands Tribunal;
  • Negotiating the surrender of an Agricultural Holdings Act 1986 tenancy and purchase of the landlord’s freehold interest (to secure adequate compensation for dilapidations and including the negotiation of development clawback provisions in the contract)
  • Mediation in connection with a family farming partnership and the reorganisation / first registration of the family property portfolio;
  • Assisting with the formalisation / acquisition of a number of easements in connection with the future re-development of a farm in south Cheshire;
  • Assisting with the property aspects of the acquisition of a large quarry business in Mid-Wales including the reservation of rights to assist the future redevelopment of part of the quarry;
  • Negotiation with statutory utilities providers in connection with the provision of a number of Wayleave Agreements;
