We regularly advise on development options and clawback agreements (also known as ‘overage’ agreements) to make sure that our clients who may be selling their agricultural land are able to share in any increase in value in the future, should the land be redeveloped for non-agricultural purposes.

When acting for a purchaser, we scrutinise all clawback provisions to protect and safeguard our clients from the potentially disastrous consequences of poorly negotiated agreements.
