Biography

Robert Brothers joined Myerson as a newly qualified solicitor in September 2017 and has been a core member of the Commercial Litigation team for over eight years. He was promoted to Associate in 2020 and Senior Associate in 2023, reflecting his growing responsibility, technical ability and standing within the team.

Robert advises on a broad range of commercial disputes, including partnership and shareholder claims, commercial agency disputes, complex contractual matters and reputation management. He also has particular strength in intellectual property litigation, regularly acting in matters involving confidential information, trade marks, copyright and design rights.

Robert is known for his calm and professional manner with clients, who value his clear advice and confidence in guiding them through complex and often high-stakes disputes.

Most recently, Robert acted for a children’s services provider, Inicio Group Ltd, in a trade mark infringement claim issued in the specialist Intellectual Property and Enterprise Courts. The matter attracted press interest and was successfully settled prior to trial, demonstrating Robert’s breadth of expertise in handling complex and high profile IP disputes.

Robert remains actively engaged with sector developments through his litigation practice and wider firm involvement. He regularly contributes to Myerson’s marketing insights and thought leadership and is Head of the Manufacturing Sector Team. He has also presented numerous seminars and webinars on intellectual property, shareholder disputes, commercial agency law and contractual disputes.

Recent notable cases Robert has worked on include:

  • Acting for a large property management company and lodging an appeal following a quantum assessment hearing on a relief from forfeiture case. Issuing a professional negligence case following determination of the appeal.
  • Acting for a children’s nursery in a shareholder’s dispute brought under the Companies Act. Matter settled obtained a buy-out of shares plus substantial costs.
  • Acting for the Claimant in a high-value multi-jurisdictional commercial agency case. Issued proceedings in England and served in America.
  • Acting for an installation company in defending a contractual debt claim against a nationwide building supply organisation.
  • Acting for a claimant in a high-value professional negligence case a planning consultant following advice in relation to the purchase of a plot of land.
  • Acted for a children’s services provider in a trade mark infringement claim issued in the Intellectual Property and Enterprise Courts, attracting press interest and settling successfully prior to trial.
  • Acted on a high‑value international investment matter involving a consortium investment with Airbus into a specialist high‑altitude communications platform, advising on the operation of investment agreement restrictions for NTT Docomo and its partners in connection with a USD $100 million project.
  • Acted for three shareholders in defending an unfair prejudice claim brought by a former shareholder of Property Portal Auctions Limited, successfully resolving the dispute through a negotiated share buy‑out on O’Neill v Phillips terms and avoiding the need for litigation.
  • Acted for a UK and European commercial agent in a cross‑border agency dispute against a Taiwanese manufacturer, pursuing damages under the Commercial Agents (Council Directive) Regulations 1993 and preparing proceedings in the Business and Property Courts with service to be effected in Taiwan.

  • Acted for an international manufacturing business on the restructuring of its UK sales force, advising on termination of multiple commercial agents, valuation of potential compensation claims under the Commercial Agents Regulations, and negotiating settlements to avoid litigation.
