Biography
Clare Wainwright is a Senior Associate in Myerson’s Probate Litigation team. She advises individuals, executors, trustees and beneficiaries on a wide range of disputes arising from wills, estates and fiduciary responsibilities, bringing a pragmatic approach to resolving sensitive and often high-value family matters.
Clare qualified as a solicitor on 3 August 2009, having trained at a firm in Chester. Before joining Myerson in May 2025, she worked within the dispute resolution team at a regional firm, where she developed a particular interest in contentious probate and built broad litigation experience across a range of disputes.
Her work includes challenging or defending the validity of wills (including, for example, allegations of undue influence and lack of testamentary capacity), pursuing and defending claims under the Inheritance (Provision for Family and Dependants) Act 1975, and advising on executor and trustee disputes.
Clare also deals with applications for the removal of executors or administrators and disputes concerning lifetime gifts as well as claims in proprietary estoppel, which arise where someone has relied on a promise or assurance about a property, often within a family context, to their detriment, and it would be unfair not to honour it.
Clare is experienced in guiding clients through dispute resolution processes, including mediation and other forms of alternative dispute resolution, with a focus on achieving proportionate outcomes and preserving relationships where possible. She has experience of working with clients in the agricultural sector, where succession planning and estate issues can involve complex family and business dynamics.
Clare is working towards full accreditation with ACTAPS (the Association of Contentious Trust and Probate Specialists), reflecting her commitment to maintaining strong technical knowledge in this specialist area. She supports clients from the outset of a dispute through to settlement or trial, providing clear advice on risk, evidence and strategy at each stage.
