The recent engagement of pop superstar Taylor Swift and NFL player Travis Kelce has attracted worldwide headlines.
Alongside the congratulations, one topic has sparked speculation in both the media and legal circles: will they sign a prenuptial agreement?
With both Taylor and Travis having considerable success in their respective fields, it is hardly surprising that this question is being asked. Taylor’s net worth is estimated to be over £1billion, thanks to her record-breaking tours, music, capital and business ventures. Travis, meanwhile, has carved out a hugely successful career in American football with an estimated fortune of around £36 million.
Our Family Lawyers explore how prenups work and whether they are just for celebrities.
What is a prenuptial agreement?
A prenuptial agreement is a legal agreement made between two individuals before they marry or enter into a civil partnership.
The agreement can set out a variety of provisions as to how the couple intend to divide their assets in the event of any future divorce or dissolution of their civil partnership.
The agreement can define which assets are classed as matrimonial property, i.e. assets built up during the marriage or held in joint names and those classed as non-matrimonial, such as inheritance or gifts received by one.
In England and Wales, prenuptial agreements are not automatically legally binding, but since the landmark case of Radmacher and Granatino in 2010, where the court said: ‘The court should give effect to a nuptial agreement that is freely entered into by each party with a full appreciation of its implications unless in the circumstances prevailing it would not be fair to hold the parties to their agreement, the court will give significant weight to prenuptial agreements provided: -
- Both parties enter into the agreement freely
- There was full financial disclosure
- Each party had independent legal advice
- The terms were fair and met the needs of the parties
In practice, this means that prenuptial agreements can carry considerable weight and can help couples protect assets and avoid later disputes.
Why celebrities use prenuptial agreements
A celebrity marriage will often involve complex financial arrangements and public scrutiny. A prenuptial agreement can help to: -
- Protect intellectual property rights
- Guard against privacy battles
- Manage international assets
What might Taylor and Travis consider in their prenuptial agreement?
If Taylor and Travis do choose to enter into a prenuptial agreement, their advisers may focus on protecting their existing wealth, such as Taylor's music catalogue and ongoing royalties and Travis’s sports earnings and endorsements.
The agreement could also consider future earnings, as both are still at the peak of their careers, so provisions for future income will be necessary.
Confidentiality will be necessary, and both Taylor and Travis will want to consider an agreement to keep financial and personal details private in the event of a future split.
A prenuptial agreement can include a confidentiality clause providing that neither party may disclose all or part of the agreement (save for the purpose of taking legal advice) to a third party or to the press.
Why prenuptial agreements are not just for celebrities
While prenuptial agreements often make the headlines when famous people are involved, they can be just as valuable for ordinary couples. Some common scenarios in which a prenuptial agreement could be beneficial include:
- Second marriages – where one or both spouses want to protect assets for children from a previous relationship, for inheritance planning
- Family wealth – if one partner expects to inherit or already owns property or business interests
- Unequal contribution – where one partner brings significantly more assets into the marriage
- Business protection – shielding a family business from being divided in divorce proceedings
- International factors - where one or both spouses have a connection with, or property in, another jurisdiction
Prenuptial agreements are versatile planning tools not just for celebrities. A prenuptial agreement can give more certainty as to the financial arrangements if you separate, and it can play a vital role in financial planning.
Entering into a prenuptial agreement can encourage open communication between you and your future spouse and give both partners peace of mind and a clear framework for the future.
