The existence of the Trust (whether on or off shore) will always need to be disclosed, even if the party who has an interest in a Trust does not feel that it would be relevant or make any difference to the financial settlement.

Long standing trust arrangements benefitting future generations, and those set up principally to protect the blood line wealth of future generations from divorce are more likely to be regarded as a “non-matrimonial” asset, and therefore not available for distribution, save to meet needs.

Trust arrangements set up with the specific intention of protecting assets from claims made by the poorer spouse on divorce are vulnerable to be set aside.

In general, a discretionary trust is often useful to protect family wealth.  If there is a history of trustees advancing funds to beneficiaries, the courts might infer that these resources will continue into the future, and the court might seek to encourage the trustees to advance capital or income to meet a financial court award.
