This negotiation can take place between the couple or via solicitors. However, the Mediation process and the Collaborative process are cost effective and non-confrontational ways of resolving outstanding financial matters.

It is always preferable to resolve financial negotiations on a consensual basis. As a last resort, court proceedings can be issued. Court proceedings can be expensive and lengthy, and the court procedure can increase anxiety.

Since 6th April 2011, those who are in dispute over financial issues arising as a result of relationship breakdown, must first attend a Mediation & Assessment Meeting with a family mediator (subject to various exceptions) before they can embark on the court process to resolve family matters.
