How to get a divorce

The divorce procedure can seem daunting, however, below we have outlined the general process.

  • The divorce petition will be filed at court
  • The court posts the petition to the other spouse
  • The other spouse has 7 days to return the acknowledgement of service, in which they confirm whether they consent to the divorce
  • Once this is received, we can apply for the Decree Nisi.
  • Six weeks later after the Decree Nisi, we can apply for the Decree Absolute, which will legally confirm the divorce.

How long does a divorce take?

The divorce process can take four to six months, and usually there is no need to attend court, unless there is a disagreement regarding the grounds for the divorce or costs.

The divorce process can be prolonged if the other spouse fails to acknowledge the divorce papers, or if there are unresolved financial issues.

How much does a divorce cost?

In certain situations, you can claim your legal costs from your spouse within the divorce petition. For example, if the divorce is due to your spouse’s unreasonable behaviour or adulterous relationship.

We will discuss the potential legal costs in our initial consultation, where will provide you with all the relevant information, so you can make an informed decision.

Grounds for divorce

There is only one ground for divorce: that is that the marriage has irretrievably broken down.

This can be proven by one of five facts:

  • Unreasonable behaviour
  • Adultery
  • 2 years separation with consent
  • 5 years separation or desertion.
