A guarantee is a contractual agreement to ensure a third party fulfils its obligations and/or a promise to fulfil those obligations if the third party fails to do so. The most common scenario is a third party guaranteeing a loan from a lender to a borrower. The guarantor promises the lender that the borrower will perform its obligations and if it does not, the guarantor will perform them on its behalf.

We are frequently instructed by guarantors seeking to challenge or terminate a guarantee, and by lenders seeking to enforce guarantees.
