In this edition of our Employment Newsletter we revisit the issue of agency workers and consider recent developments in this area. We also detail employment law changes taking effect this October 2015.
The Agency Workers Regulations 2010 came into force on 1st October 2011 giving effect to the EU Temporary Workers Directive and introducing new rights for agency workers.
The Regulations are in some respects complex and subject to various exemptions and derogations but a summary of the key provisions follows.
EMPLOYMENT LAW CHANGES IN OCTOBER 2015
National Minimum Wage increase
From Thursday 1 October 2015, the National Minimum Wage rates increased from £6.50 to £6.70 per hour for adults over the age of 21.
Smoking ban in company cars
Company vehicles must be smoke free unless they are used mainly for an employee’s private purposes (in accordance with the smoke-free legislation).
Sikh safety helmet exemption
Sikh men are exempt from the requirement to wear safety helmets while on a construction site.
Modern Slavery statements
Employers with an annual turnover of £36 million or more carrying on any of their business within the UK are required to publish a slavery and human trafficking statement each financial year.
