New evidence suggests that RBS staff were encouraged to transfer customers to the GRG (Global Restructuring Group) wherever possible. Once the transfer was made, the GRG would charge unnecessary fees, force the sale of assets and generally caused significant financial loss.

 RBS has set aside a fund of £400 million for affected SME customers and it is estimated that approximately 12,000 SME’s could be in line to receive compensation.

 RBS will automatically refund complex fees paid by about 4,000 small business GRG customers between 2008 and 2013, and will also set up a new complaints process. The complaints process will be overseen by retired High Court Judge Sir William Blackburn.  However, even though this new complaints redress scheme and automatic refund has been announced, this is unlikely to adequately compensate customers whom the FCA has said were ‘inappropriately’ treated by RBS.

An action against West Register (Global Restructuring Group) does not need to stem from mis-selling of a financial product and the instances of economic pressure placed on the customers can give rise to a claim.
