We understand that buying or selling a farm requires specialist skills above and beyond simply examining the title deeds for the property and the profit and loss account for the business.

It extends into the regulatory environment and cross compliance regime in which the farming business operates. Tenanted farms also require specialist knowledge and experience. Environmental standards, pollution, cross compliance and greening obligations as well as Stewardship obligations and the transfer of Entitlements all need to be considered when buying or selling a farm and the appropriate safeguards put into the sale contract.

We recognise that there is increasing pressure on agricultural land in our region for development and the accommodation of future housing and we regularly advise our clients on how best to harness this demand. We regularly advise on development options and clawback agreements (also known as ‘overage’ agreements) to make sure that our clients who may be selling their agricultural land are able to share in any increase in value in the future, should the land be redeveloped for non-agricultural purposes.

When acting for a purchaser, we scrutinise all clawback provisions to protect and safeguard our clients from the potentially disastrous consequences of poorly negotiated agreements.
