Here are the latest legislative updates for Spring 2015
Horses Act 2015 – a major step forward in simplifying the procedure for removal of fly grazing horses. The act simplifies the procedure for the seizure and disposal of fly-grazing horses on land.
Deregulation Act 2015 – introduces new rules (which came into force on 26th May 2015) to simplify the arbitration procedure for certain Agricultural Holdings Act (“AHA 1986”) tenancy disputes and to bring these into line with the current procedure under the Agricultural Tenancies Act 1995.
Under the new rules, the landlord and the tenant are free to agree on the appointment of a third party best suited to determine their dispute, such as a local land agent or a local land surveyor (rather than being forced down the route of arbitration). They are also able to agree the terms and conditions of the appointment, including timeframes and process.
The notice requirements and time limits that also apply to arbitration under the AHA 1986 will not apply to such third-party determination.
New Model Clauses Regulations – simplify and modernise the Model Clauses in Agricultural Holdings Act tenancies regarding liability for fixed equipment.
